Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Flowjat — the ad copilot for builders — and the related website, applications and services (together, the "Service") operated by Guillaume SEVRIN, Entrepreneur individuel (EI) (SIREN 887 963 346), trading as Flowjat ("we", "us" or "our"). Flowjat is built for indie developers and small teams who run paid advertising without having the time to become advertising experts. The Service connects your ad accounts and developer revenue tools, and a copilot suggests, in plain language, what to change. Suggestions are guidance — not instructions to follow blindly. You stay in control of your campaigns and your spend at all times.

1. Acceptance of these Terms

By creating an account, clicking "I agree" (or similar), or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy and Acceptable Use Policy, which are incorporated by reference. If you do not agree, do not use the Service.

You must be at least 18 years old (or the age of majority where you live) and legally able to enter into a contract. If you use the Service on behalf of a company or other organisation, you represent that you are authorised to bind that entity, and "you" refers to that entity. You may not use the Service if you are barred from doing so under applicable law.

2. Description of the Service

Flowjat unifies advertising platforms and developer revenue tools so you can see real return on ad spend (ROAS) in one calm place, and a copilot prioritises the actions that matter. Concretely, the Service may let you:

• connect advertising accounts (such as Meta, Google Ads, TikTok and Apple Search Ads) and revenue tools (such as Stripe, Paddle and RevenueCat);
• view unified metrics, spend and revenue, and a single ROAS picture across sources;
• receive plain-language suggestions — "here's what to change" — that you choose whether to act on.

Flowjat is an early-stage product under active development. Some platform connections are still being validated and may be enabled progressively; integrations connect at launch or as we complete validation, not all at once. We may add, change, suspend or remove features at any time. We will try to give reasonable notice of material changes that adversely affect a paid plan.

3. Accounts & security

To use most of the Service you need an account. You agree to provide accurate information and to keep it up to date. You are responsible for:

• maintaining the confidentiality of your login credentials and any access tokens;
• all activity that occurs under your account, whether or not authorised by you;
• using a strong, unique password and enabling additional protections where available.

Notify us promptly at security@flowjat.com if you suspect any unauthorised use of, or security issue affecting, your account. We are not liable for any loss arising from unauthorised use of your account that results from your failure to keep your credentials secure.

4. Plans, billing & trials

Current plans, prices and any free tier or trial are described on our pricing page. Unless stated otherwise:

• paid plans are billed in advance on a recurring basis (for example monthly or annually) and renew automatically until cancelled;
• you authorise us and our payment processor to charge the payment method on file for all fees due;
• fees are stated exclusive of taxes; you are responsible for any applicable VAT or other taxes, which we may add where required;
• any free trial converts to a paid plan at the end of the trial period unless you cancel before it ends.

You can cancel a paid plan at any time from your account settings; cancellation takes effect at the end of the current billing period and you keep access until then. Except where required by law, fees already paid are non-refundable and we do not provide prorated refunds for partial periods — see our Refund & Cancellation Policy for details. We may change prices for future billing periods and will give you reasonable advance notice. Important: subscription fees are separate from the money you spend on advertising platforms — your ad spend is paid directly to those platforms and is never collected or controlled by Flowjat.

5. Acceptable use

Your use of the Service must comply with our Acceptable Use Policy and all applicable laws. Among other things, you agree not to:

• break the law or infringe anyone's rights, including intellectual property and privacy rights;
• use the Service to advertise prohibited, deceptive or fraudulent offerings, or to violate the policies of any connected ad platform;
• reverse engineer, scrape, overload, probe or interfere with the Service or its security;
• resell or provide the Service to third parties except as expressly permitted, or share your account with others.

6. Third-party connections

The Service is most useful when you connect your own ad and revenue accounts. When you do, you authorise Flowjat to access, retrieve and process data from those accounts — and, where you enable it, to read and prepare changes — on your behalf, through the relevant platform APIs and within the scopes you grant. You can revoke this access at any time by disconnecting the integration or revoking permission with the platform.

You are solely responsible for:

• having the right to connect each account and to share its data with us;
• complying with each platform's own terms, advertising policies and API terms (for example those of Meta, Google, TikTok, Snapchat or Apple) — those terms govern your relationship with each platform;
• all advertising spend, campaigns, budgets and charges incurred on your connected accounts, including any changes made on your instruction or with your confirmation through Flowjat.

Third-party platforms are independent of Flowjat. We do not control them, we are not responsible for their availability, decisions, policies or charges, and they may change or withdraw API access at any time, which may affect the Service.

7. Intellectual property

The Service, including its software, design, text, graphics and the Flowjat name and logo, is owned by Flowjat and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes. We reserve all rights not expressly granted.

You retain ownership of the data you submit or that we retrieve from your connected accounts on your behalf ("Your Data"). You grant us a licence to host, process and use Your Data as necessary to provide, secure and improve the Service and to generate suggestions for you, in accordance with our Privacy Policy. If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them without obligation to you.

8. Suggestions & no guarantee of results

The Flowjat copilot provides suggestions and analysis — not advice, predictions or guarantees. Advertising performance depends on many factors outside our control, including your product, market, creative, budgets and the platforms themselves.

• We do not warrant any particular outcome, return on ad spend, revenue, ranking or performance.
• You are responsible for reviewing every suggestion and for deciding whether to apply it. Where a change can be applied through the Service, it requires your validation; you remain the decision-maker.
• Suggestions are not financial, legal, tax or professional advice.

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data from third-party platforms will be complete or accurate. Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law, including mandatory consumer protections.

9. Limitation of liability

To the maximum extent permitted by law, Flowjat and its directors, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunities.

In particular, and without limiting the above, Flowjat is not liable for any advertising spend, budget changes, campaign modifications, lost performance or charges on your connected accounts — including changes you make, instruct or confirm based on a suggestion. You are responsible for your campaigns and your spend.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total fees you paid us for the Service in the three (3) months before the event giving rise to the claim, or (b) fifty euros (€50). These limitations apply regardless of the legal theory and even if we have been advised of the possibility of such damages. Some of these limitations may not apply to consumers where prohibited by law.

10. Indemnification

You agree to indemnify, defend and hold harmless Flowjat and its directors, employees and suppliers from and against any claims, liabilities, damages, losses and reasonable expenses (including legal fees) arising out of or related to: (a) your use of the Service; (b) Your Data or the accounts you connect; (c) your advertising activity, spend or campaigns; (d) your breach of these Terms or of any third-party platform's terms; or (e) your violation of any law or of the rights of a third party.

11. Suspension & termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access, in whole or in part, with or without notice, if we reasonably believe that you have breached these Terms or the Acceptable Use Policy, that your use poses a security or legal risk, or where required to do so by law or by a third-party platform.

On termination, your right to use the Service ends and we may delete or anonymise Your Data in accordance with our Privacy Policy and applicable retention obligations. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification and governing law — will continue to apply.

12. Governing law & disputes

These Terms are governed by the laws of France, without regard to conflict-of-laws rules. Subject to any mandatory consumer protection rules that grant you the right to bring proceedings in your country of residence, the courts of France will have jurisdiction over any dispute arising out of or relating to these Terms or the Service.

If you are a consumer in the European Union, you may also use the European Commission's online dispute resolution platform. Before bringing a formal claim, we encourage you to contact us at legal@flowjat.com so we can try to resolve the matter informally.

13. Changes to these Terms

We may update these Terms from time to time, for example to reflect new features, legal requirements or changes to the Service. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or in the product. Changes take effect when posted unless stated otherwise. By continuing to use the Service after changes take effect, you accept the updated Terms; if you do not agree, you should stop using the Service and may cancel your plan.

14. General

These Terms, together with the documents they reference, are the entire agreement between you and Flowjat regarding the Service. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. For company and legal details, see our Legal notice.
